Major penalty coming for the #38? bleeder valves found on the tires

Read this over at jayski's.  It sounds like the #38 could have a 200 point $200,000 penalty coming and could put Robby back in the Top 35!!!

 

 

Illegal bleeder valves on the #38 at Pocono? Sources tell Sirius that NASCAR discovered clandestine [secrecy or concealed] air pressure bleeder valves on the tires of Travis Kvapil's #38 Front Row Motorsports Ford Sunday at Pocono Raceway. Following the rain delay, NASCAR officials reportedly observed two soft tires on the rear of Kvapil's car and held him from rolling back onto the track for the start of the race. Closer examination of those tire and wheel assemblies allegedly revealed illegal bleeder valves, which purge excess air pressure from the tires as it accumulates under race conditions. If confirmed, the team would likely face a major NASCAR penalty, since tires are considered to be one of the sanctions "untouchable" items, along with engines and fuel.(Sirius Speedway)(6-8-2010)

Pockrass adds: Knocks Kvapil (No. 38) out of top 35, puts Robby Gordon in; team can ask pt penalty be deferred pending appeal but NASCAR can deny request.
And they had better. There's not a precedent that I know of for deferring. Even if the penalty is reduced, it won't be enough to put them back in the top 35.
Compared to what was thought by some,Monday morning 150 points is big.
Hold the phone. Front Row will appeal. Waiting to see if NASCAR will hold off on the point deduction.
That's not written in stone. NASCAR can defer. Waiting for the official word whether they will or won't.
Recent precedent would indicate that they won't defer, but look who you're dealing with.
FRM can request a deferral of the penalty until the appeal hearing but it's seldom granted.
FRM has been playing games with it drivers all year why would this be any differnt, there hope is that robby misses an other race then the points do not mater!

In a statement released by the team after the penalty was announced, Front Row Motorsports owner Bob Jenkins said: "We take the rules of this sport very seriously, and we support NASCAR in its enforcement of those rules.

"It was not our intent to put unapproved valve stem caps on our car at Pocono, a track where such a maneuver would clearly not provide any advantage. We are conducting our own internal investigation to determine how those parts got into our inventory and onto our car last weekend.

"While we recognize we have to pay for our mistake, this was an unintentional, isolated incident,"

Jenkins continued. "We plan to immediately submit an appeal through NASCAR's formal appeal process as outlined by the NASCAR rule book."

The team's three entries will compete this weekend at Michigan.

The loss of 150 owner points drops to No. 38 to 36th in points. The No. 7 team of Robby Gordon moves into the top 35 and, per the NASCAR rule book, is guaranteed a starting position at Michigan.
This is unfortunate news for the 38 team, but couldn't have come at a better time for RGM. With the 71 team deciding to "Start and Park" until more sponsorship is found, the penalty will give RGM some time to gain points before the appeal will be heard. (It's highly doubtful FRM will win their appeal with this type of infraction. They will need hard evidence proving their innocence). If RGM can have a solid run at Michigan & Sonoma, it won't matter whatever the outcome of the appeal. RGM will likely pass the 71 in points regardless.
Having RGM in the Top 35 this weekend will be a huge benefit it gaining points.
Sort of like MWR trying to figure out how rocket fuel got into the 55 a few years ago. Not sure how this could be accidental. Lame excuses are just going to piss NASCAR off more.

woo hooo. So glad Robby is back in the top 35. I dont like its because of a team getting points taken but with the whole driver swapping FRM has been doing this season I dont feel sorry for them.
