If they apeal the penality will the points be taken until after the apeal process are as soon as the judgement handed down?

If points are taken after the apeal he should be able to stay in the top 35 and give him a chance to build his lead in the next 2 races.........

Points will be deducted immediately.
This will be a serious set-back as NASCAR cannot go back and un-do whatever transpires between the penalty and any successful appeal.

Personally, I don't see how whatever penalty could successfully be appealed. The car was low.

Unless I miscounted - which is a possibility, there are just 44 cars entered for Richmond.
