An attorney representing Elliott Sadler has filed notice in Iredell County (N.C.) court saying the NASCAR driver intends to claim that Gillett Evernham Motorsports has breached Sadler's contract to drive the Sprint Cup team's No. 19 Dodges.

John Buric, Sadler's lawyer, filed an "application and order extending time to file complaint" Wednesday in Iredell County Superior Court. Sadler has until Jan. 20 to file an actual complaint if the parties cannot reach an agreement on their dispute.

According to the form, Sadler plans to seek "injunctive relief, declaratory relief/specific performance, consequential and punitive damages as a result of Defendants anticipatory and actual breach of Plaintiffs' Driving Services Agreement. ... Plaintiffs also seek general, consequential, treble and punitive damages, and attorney fees, as a result of Defendants' tortuous interference ..."

George Gillett, Gillette Evernham Motorsports, Anthony James Allmendinger and Ray Evernham Enterprises are named as defendants.

Buric said Sadler learned on Tuesday that GEM had engaged in negotiations with Allmendinger about driving the No. 19 Dodges in 2009. Buric said there had been "communication" with Sadler earlier, telling him that a change was being considered. But he said Sadler did not know there had been actual negotiations until he received phone calls about media reports that Allmendinger was being lined up to replace him.

"Elliott is ready, willing and able to fulfill his contractual obligations," Buric said. Sadler earlier this year signed an extension of his contract with GEM that runs through 2010.

"Gillett Evernham Motorsports policy does not allow us to comment on potential or pending legal matters involving the race team," said Ryan Barry, a spokesman for the organization.

Sadler has three Cup Series victories in 357 career races. He joined Evernham Motorsports in August 2006 to drive the No. 19. He finished 25th in the 2007 driver standings and 24th in 2008.

Allmendinger has made 44 career Cup starts since moving to NASCAR from the Champ Car World Series ranks. He drove in the final five races of the 2008 season in the No. 10 Dodges owned by GEM, finishing 16th or better in four of them.

Gee Elliott, how does it feel to be on the other end of crap like this? Maybe he has a better understanding of how Mayfield felt when he and Ray did this to Jeremy. Karma is a mutha. I feel no sympathy.
Mayfield did it to himself. He has burned every bridge he has had in Nascar, and now sits on the sidelines because of it. The two situations are not similar in any way.

Everyone wants to blame Ray and site Atwood and Mayfield as examples of him screwing people over, but they have no idea what its like to work with either of them. Atwood has no drive to succeed, and Mayfield was, is, and always will be over-rated.

Before you throw Ray under the bus, lets remember he revived Bill Elliotts career, and rescued Kasey Kahne from being buried in crap equipment from ford and Yates Racing and gave him a platform to perform.
It was done badly. Ray was free to do whatever he wanted to with his team. At the time, I was a HUGE Sadler fan. I had "people" on the inside and there were things that weren't widely know to the public at the time. It was a chicken shit way to handle it. That was my point. Elliott was playing Mr Innocent, and he wasn't. That was when I stopped being a supporter of him. That ahh sucks good ole' boy act started to wear thin for me.

I'm not a fan of Sadler's by any means.Never was a fan of the driver, & didn't care for him personally either...good 'ole boy, my ass. I've heard too much behind the scenes crap about the guy from friends that work at GEM (stuff about personal life- not as a driver) to have much hope I'd change that any time soon. But what I don't like about this whole situation is that Sadler's contract was extended for 2 years in May, & now Gillett has decided to replace him. I assume that both parties signed in good faith...so WTF. Gillett better plan on paying him a nice check for the whole 2 year contract, in which case this stunt hasn't saved GEM a cent. Both drivers & owners should fulfill their contracts...end of story. Sadler isn't stupid bringing in his attorneys. RG would do the same.
I'm no fan of Sadler either, but a contract is a contract and he should be paid. I'm not ure what is up with GEM though. Sadler isn't any worse of a driver now compared to what he was in May. In tight economic times, signing a driver that you cut before the extension really even starts doesn't make sense to me.
Oh...no worries..GEM has to pay Sadler the value of those remaoining two years...and probably more (ie say he makes an extra million or two in merchandise sales...well those are forseeable damages and will get tacked on).

I am sure GEM will want to settle out of court, but it is going to take a decent sized number above just the 2 years salary to do so.
Meh. Go Stephan Marbury route. Pay him and keep him under contract but out of the car. Don't allow him to go to any other team.
They already F$%#ed Elliot enough by pulling this so late, they'll just pay him off. After this and how they did Patrick, GEM is just scoring big garage points, Hockey scmucks. Judge Wapner say's put Dick Sadler in the 10 car.
